Terms and Conditions for Okikiogo Creative

Please read these Terms and Conditions (“Terms”) carefully before subscribing to Okikiogo Creative’s services, which provide access to our library of Elementor website templates and Elementor and WordPress courses (the “Services”).
By subscribing to or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Services.
1. The Services We Provide
Okikiogo Creative provides subscription-based access to:
- A library of Elementor website templates: These templates were acquired by us, and we grant you access to use them within the scope of your subscription. We are not the creators or original sellers of these templates. You acknowledge that these templates may be available from other sources online.
- Elementor and WordPress courses: These courses were acquired by us, and we grant you access to view them within the scope of your subscription. We are not the creators or original sellers of these courses. You acknowledge that these courses may be available from other sources online.
Important Note: We are not selling the individual templates or courses themselves, but rather the access to our curated library of these resources for the duration of your active subscription.
2. Subscription Plans and Payment
2.1. Subscription: Access to our Services is provided on a subscription basis. You must select a subscription plan and provide accurate and complete billing information.
2.2. Fees: You agree to pay all fees associated with your chosen subscription plan. All fees are in Nigerian Naira (NGN) unless otherwise stated and are non-refundable, except as expressly provided in these Terms.
2.3. Billing Cycle: Your subscription will automatically renew at the end of each billing cycle (e.g., monthly, annually) unless you cancel it in accordance with Section 3.
2.4. Payment Processing: We use third-party payment processors to handle subscription payments. By subscribing, you agree to their terms and conditions. We do not store your full payment card details on our servers.
2.5. Price Changes: We reserve the right to change our subscription fees at any time. We will provide you with reasonable advance notice of any price changes. If you do not agree with the new fees, you may cancel your subscription before the new fees take effect.
3. Cancellation and Refunds
3.1. Cancellation by You: You may cancel your subscription at any time through your account settings or by contacting our support team. Your access to the Services will continue until the end of your current billing period, and you will not be charged for subsequent periods.
3.2. No Refunds: Generally, subscription fees are non-refundable. We do not offer refunds for partial subscription periods or unused access.
3.3. Exceptional Circumstances: Any refunds for exceptional circumstances will be at our sole discretion.
4. User Accounts and Responsibilities
4.1. Account Creation: To access our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2. Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4.3. Prohibited Conduct: You agree not to: * Share your account access with any other person. * Resell, sublicense, distribute, or otherwise commercially exploit any of the templates or courses accessed through our Services. * Use the Services for any unlawful purpose or in any way that could harm Okikiogo Creative or any third party. * Attempt to bypass any security or access control measures. * Engage in any activity that interferes with or disrupts the integrity or performance of the Services.
5. Intellectual Property
5.1. Our Rights: All content provided through our Services, including but not limited to our website design, logos, text, graphics (excluding the third-party templates and courses themselves), and our compilation of such third-party content, are owned by or licensed to Okikiogo Creative and are protected by intellectual property laws.
5.2. Third-Party Content: You acknowledge that the Elementor templates and WordPress/Elementor courses are the intellectual property of their respective creators/owners. Your subscription grants you access to use these resources in accordance with their respective licenses (if any) and the terms of your subscription with us. We do not grant you any ownership rights to these third-party intellectual properties.
6. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. OKIKIOGO CREATIVE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
- THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
- ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OKIKIOGO CREATIVE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
8. Indemnification
You agree to indemnify, defend, and hold harmless Okikiogo Creative and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms or your use of the Services.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in Lagos, Nigeria.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
